Screen Crack Protection Plan - Terms, Conditions & Policies

Disclaimer

The Screen Crack Protection Plan offered by ENS Smart Solution Sdn Bhd is a service-based protection program and does not constitute an insurance policy, takaful product, extended warranty, or financial product regulated by Bank Negara Malaysia. No element of risk pooling, indemnity insurance, or underwriting is provided. Coverage is strictly limited to repair services as expressly stated in these Terms and Conditions.

No Warranty and No Guarantee of Outcome

All services are provided on an "as-is" and "as-available" basis. While ENS Smart Solution Sdn Bhd endeavours to perform repairs using reasonable skill and care, the Company makes no representation or warranty, express or implied, regarding the outcome, durability, or future performance of any repaired Device. Repair results may vary depending on the Device's condition, age, model, availability of replacement parts, and manufacturer specifications.

Force Majeure

ENS Smart Solution Sdn Bhd shall not be liable for any failure, delay, or interruption in performance of its obligations where such failure arises from events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, strikes, supply chain disruptions, courier delays, service centre closures, or shortages of replacement parts. In such circumstances, service timelines may be reasonably extended without liability.

Service Centre and Parts Availability

All repairs are subject to availability of authorised or designated service centres and compatible replacement parts. The Company reserves the right to assign repair work to any service centre deemed appropriate. In the event that replacement parts are unavailable or discontinued, the Company may, at its discretion, offer alternative solutions or decline the claim without incurring liability.

Customer Responsibilities

The Customer is solely responsible for backing up all data, applications, photos, files, and personal information stored on the Device prior to submitting it for repair. ENS Smart Solution Sdn Bhd, its service centres, and partners shall not be responsible for any loss, corruption, or unauthorised access to data arising during inspection, repair, handling, or transportation of the Device.

The Customer must ensure that the Device submitted matches the registered IMEI and has not been tampered with, modified, or repaired by unauthorised parties prior to submission.

Limitation of Liability

To the fullest extent permitted by applicable law, ENS Smart Solution Sdn Bhd shall not be liable for any indirect, incidental, special, consequential, or economic losses, including loss of data, loss of use, loss of business, or loss of profits, whether arising in contract, tort, negligence, or otherwise. The Company's total liability, if any, shall be strictly limited to the cost of the screen repair performed under the Protection Plan.

Fraud, Abuse, and Misrepresentation

ENS Smart Solution Sdn Bhd reserves the absolute right to reject, suspend, or terminate any Protection Plan or claim where fraud, misrepresentation, falsification of documents, tampering of IMEI, repeated abuse, or attempted circumvention of claim limits is suspected. Any such determination shall be final and binding, without obligation to provide compensation or refund.

Refund, Cancellation, and Non-Transferability Policy

All Protection Plan purchases are final. Fees paid are non-refundable, non-cancellable, and non-transferable once the plan is successfully registered and activated. The Protection Plan cannot be transferred to another Device, IMEI, or individual under any circumstances.

Intellectual Property Rights

All content on this website, including but not limited to text, images, graphics, logos, system architecture, workflows, user interfaces, databases, and software, are the property of ENS Smart Solution Sdn Bhd and are protected by intellectual property laws. No content may be copied, reproduced, distributed, or used without prior written consent.

Website Usage and Cookies Policy

The ENS Smart Solution website uses cookies and similar technologies to enable account login, registration, document uploads, security authentication, performance monitoring, and analytics. By accessing and using the website, the Customer consents to the use of cookies in accordance with this policy. Users may disable cookies through browser settings, subject to potential limitations in website functionality.

Personal Data Protection Notice (PDPA)

ENS Smart Solution Sdn Bhd collects and processes personal data in compliance with the Personal Data Protection Act 2010 (PDPA). Personal data collected may include name, email address, contact details, purchase receipts, IMEI numbers, images of Devices, claim documents, and communication records. Such data is used strictly for registration verification, claim processing, customer support, regulatory compliance, and internal administration.

Personal data may be disclosed to authorised service centres, logistics partners, IT service providers, or regulatory authorities where necessary. The Company implements reasonable security measures to safeguard personal data but does not guarantee absolute security. By using the website and services, the Customer consents to the collection, processing, storage, and retention of personal data in accordance with this notice.

Age and Legal Capacity

By registering for and purchasing the Protection Plan, the Customer represents and warrants that they are at least eighteen (18) years old and have the legal capacity to enter into a binding contract under Malaysian law.

Amendment and Severability

ENS Smart Solution Sdn Bhd reserves the right to amend, revise, or update these policies at any time without prior notice. If any provision is held to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall continue in full force and effect.

Governing Law and Jurisdiction

These policies shall be governed by and construed in accordance with the laws of Malaysia. The courts of Malaysia shall have exclusive jurisdiction over any disputes arising out of or in connection with the website or Protection Plan.
